Exactly What Is Probate?
According to Black's Law Dictionary, probate is: "Court procedure by which a Will is proved to be valid or invalid; though in current usage this term has been expanded to generally include all matters and proceedings pertaining to administration of estates..."
In other words, probate is the procedure for transferring property to heirs and beneficiaries and otherwise settling the affairs of the person who has died. In addition, Washington state allows a limit to the time creditors can make a claim against the estate.
Probate laws vary from state to state. Washington state has very liberal probate laws, hence the reason so many estates here are administered by the heirs and without an attorney.
There is no substitution for legal advice and we encourage everyone to seek legal advice before beginning any legal endeavor on their own. You can hire an attorney just for legal advice and get all of your questions answered before you begin a legal process. We are a paralegal service and we do not give legal advice.
When seeking legal advice here are a few tips to keep in mind:
1. Before making an appointment with an attorney be sure and find out what they charge per hour. That way you will know exactly what the advice is going to cost you.
2. Before the appointment, write down all of the questions and concerns you want addressed.
3. Take someone with you to the appointment. This way you have a second set of ears to hear what the attorney is saying while you are writing down answers. You can even ask the attorney if you can record the appointment for playback later on.
There are attorneys who specialize just in probate matters. Although most attorneys do handle probate, it's usually easy money for them!
You can also find an attorney through the King County Bar Association lawyer referral program. You pay $35 for a half hour with the attorney, pretty good deal! Be sure and find out what their hourly rate is when you make the appointment in case your session goes over a half hour. Here is the link for the lawyer referral program:
